To IMPEACH OR NOT TO IMPEACH 9/27/2019
Impeachment is the process by which a legislative body levels charges against a government official. It does not mean removal from office; it is only a statement of charges, akin to an indictment in criminal law. Once an individual is impeached, he or she must then face the possibility of conviction by a legislative vote, which judgment entails removal from office.
Because impeachment and conviction of officials involve an overturning of the normal constitutional procedures by which individuals achieve high office (election, ratification, or appointment) and because it generally requires a supermajority, they are usually reserved for those deemed to have committed serious abuses of their office. In the United States, for example, impeachment at the federal level is limited to those who may have committed "Treason, Bribery, or other high crimes or misdemeanors.
The proceedings unfold in the form of a trial, with each side having the right to call witnesses and perform cross-examinations. The House members, who are given the collective title of managers during the course of the trial, present the prosecution case, and the impeached official has the right to mount a defense with his or her own attorneys as well. Senators must also take an oath or affirmation that they will perform their duties honestly and with due diligence.
After hearing the charges, the Senate usually deliberates in private. The Constitution requires a two-thirds super majority to convict a person being impeached.[25] The Senate enters judgment on its decision, whether that be to convict or acquit, and a copy of the judgment is filed with the Secretary of State.[18] Upon conviction in the Senate, the official is automatically removed from office and may also be barred from holding future office.
The democrat controlled House of Representatives has painted themselves into a corner. Let us clarify, they have not yet started impeachment proceedings, what they are doing is continuing their never ending investigation of Trump in order to take him out of office before the upcoming election. These investigations have not turned anything other than proof that Trump is Trump, not news to anyone that knew him or has studied his history.
I can only surmise that what seems to be an exercise in futility is prompted by the poor quality of their presidential candidates, the increase radicalism of the members, and a never ending pathological hate against a man that was supposed to lose against their “chosen one”.
Now let us analyze the latest “gotcha” that they and the mainstream media are salivating over. It starts what it is called, but is not, a “whistleblower” that alleged evidence of presidential abuse of power, based on an implied forced action to Ukraine’s president to investigate a political rival, Joe Biden and his son.
The DNI head Joseph Macguire, a man with impeccable background, explained to Congress why the allegation was not an intelligence breach but a diplomatic one as it pertained to a call between head of States.
Not deterred, the democrats insisted in the gravity of the accusations, falsely quoted the contents of the conversation even after the full unredacted transcript was released and started a new accusation of a cover up.
Now let us look at the facts as I have gathered, and are readily available.
The seven page whistleblower claims are very well and professionally written as a legal paper.
They are all explained as second and/or third hand information including the media.
This fact, by definition, makes the unknown informants, not the conduit, the real “whistleblowers”.
The crux of the declaration is an interpretation, biased against Trump, of the supposed confidential, talk between him and the newly elected president of Ukraine.
It contains no quid pro quo, overt or implied, only a reference to corruption with included, as claimed by Trump, a further investigation of Joe Biden and his son.
It was not a smooth statement by our president that only confirms his lack of political experience and his personality. Nothing comes close to “treason, bribery or other high crimes and misdemeanors”.
But look what I found investigating this writing?
There is a treaty between these two countries signed by Clinton and approved by the Senate, with Biden’s signature, that MANDATES both nations to fully cooperate in cases of corruption involving them.So not only Trump’s mention of Biden’s alleged malfeasant was legal but mandated. Here is proof;
“To the Senate of the United States: With a view to receiving the advice and consent of the Senate to ratification, I transmit herewith the Treaty Between the United States of America and Ukraine on Mutual Legal Assistance in Criminal Matters with Annex, signed at Kiev on July 22, 1998. I transmit also, for the information of the Senate, an exchange of notes which was signed on September 30, 1999, which provides for its provisional application, as well as the report of the Department of State with respect to the Treaty. The Treaty is one of a series of modern mutual legal assistance treaties being negotiated by the United States in order to counter criminal activities more effectively.
The Treaty should be an effective tool to assist in the prosecution of a wide variety of crimes, including drug trafficking offenses.
The Treaty is self-executing. It provides for a broad range of cooperation in criminal matters.
Mutual assistance available under the Treaty includes: taking of testimony or statements of persons; providing documents, records, and articles of evidence; serving documents; locating or identifying persons; transferring persons in custody for testimony or other purposes; executing requests for searches and seizures; assisting in proceedings related to restraint, confiscation, forfeiture of assets, restitution, and collection of fines; and any other form of assistance not prohibited by the laws of the requested state. I recommend that the Senate give early and favorable consideration to the Treaty and give its advice and consent to ratification.” WILLIAM J. CLINTON.
On the supposed cover up and Giuliani’s intervention, it is hard to claim cover up when the conversation was made public and the increase of security of these talks were after Mexico’s and Australia’s were leaked, and Rudy’s Ukraine contacts are from decades back before Trump and Obama and his involvement was initiated by Ukraine through our State Dpt.In summary, as of now there is no basis to start the Articles of Impeachment except for politics. Not unless AOC insists. She, btw, other than her intellectual deficits, a whistleblower told me makes a killer martini. Just saying!

LETS GET THIS PROCESS STARTED..HERE'S WHAT HAPPENS THEN..!

I have a degree in Political Science, and I am a card-carrying Libertarian. I've been studying politics and political history for the past 30 years. My specialty is U.S. Presidents. That said, I hope that the House of
Representatives impeaches Trump. Let me tell you what will happen next !
1. The House can pass articles of impeachment over the objections of the
Republicans, and refer to the Senate for trial.
2. The Senate will conduct a trial. There will be a vote, and the Republicans will vote unanimously, along with a small number of Democrats, to not convict the President. Legally, it will all be over at that point.
3. However, during the trial, and this is what no one is thinking about right now, the President's attorneys will have the right to subpoena and question ANYONE THEY WANT.. That is different than the special counsel investigation, which was very one-sided.
So, during the impeachment trial, we will be hearing testimony from James Comey, Peter Strzok, Lisa Page, Bruce Ohr, Glenn Simpson, Donna Bazile, Eric Holder, Loretta Lynch,Christopher Steele, Hillary Clinton, John Brennan, James Clapper, and a whole host of other participants in this whole sordid affair and the ensuing cover up activities.
A lot of dirt will be dug up; a lot of truth will be unveiled. Finger pointing will occur. Deals will start being made, and suddenly, a lot of democrats will start being charged and going to prison.
All this, because, remember, the President's team will now, for the first time, have the RIGHT to question all of these people under oath – and they will turn on each other. That is already starting.
4. Lastly, one more thing will happen, the Senate will not convict the President. Nothing will happen to Trump. Most Americans are clueless about political processes, the law, and the Constitution.
Most Americans believe that being impeached results in removal from office. They don't understand that phase 2 is a trial in and by the Senate, where he has zero chance of conviction.
Remember, the Senate is controlled by Republicans; they will determine what testimony is allowed -- and **everything** will be allowed, including: DNC collusion with the Clinton campaign to fix the election in favor of Hillary, the creation of the Trump dossier, the cover up and destruction of emails that very likely included incriminating information.
They will incriminate each other for lying to the FISA court, for spying and wiretapping the Trump campaign, and for colluding with foreign political actors, especially George Soros.
After the Senate declines to convict the President, we will have an election, and Trump will win. It will be a backlash against democrat petulance, temper tantrums, hypocrisy and dishonesty. Even minorities will vote for Trump, because, for the first time, they will see that democrats have spent 2+ years focused on maintaining their own power, and not doing anything at all about black murders in Chicago, homelessness, opioids, and other important issues that are actually killing people. And, we will spend the following four years listening to politicians and pundits claim that the whole impeachment was rigged.
So let's move on to impeachment.
